Comprehensive Terms & Conditions for RoamMyWay services.

Booking & Pricing

  1. All prices are dynamic and subject to change until full payment due to availability fluctuations.
  2. Hotel/activity/train bookings operate on first-come-first-served basis.
  3. Infants (below 3 years) stay free in hotels/private transfers (no extra bed).
  4. Package rates expire at 11:59 PM on the quotation date.
  5. 50% non-refundable deposit required immediately to lock package rates.
  6. Balance payment due 15 days pre-travel; delays incur 10% late fee.
  7. 5% GST + 5% TCS apply to total package cost (TCS reclaimable via ITR).

Cancellations & Refunds

  1. Individual Bookings (Hotels/Flights/Activities): Only base fare refunded (excluding taxes/fees).
  2. Packages: Non-refundable except for documented emergencies. If approved: 25% deduction + 2.5% bank charges from refundable amount.

Services & Operations

  1. Cabs: Pick-up/drop only or as per itinerary (not all-day).
  2. Activities: Some entry fees payable directly at venue. Subject to weather/operational changes (no refunds).
  3. Timings: Services available 10:00 AM - 9:00 PM; night charges apply post 9:00 PM.
  4. Vouchers: Final details in vouchers override quotes; verify timings/addresses.
  5. Infant Policy: Excludes flights/activity fees; limited to hotels/transfers.

Exclusions

  1. Not Included: Visas, Meals beyond daily breakfast, Personal expenses (tips, laundry, shopping), Optional/unmentioned tours.
  2. Force Majeure: Zero refunds for natural disasters, pandemics, flight delays, or political unrest.

Insurance & Liability

  1. Travel Insurance: RoamMyWay acts only as distributor for third-party insurance. Travelers submit claims directly to insurers with proof. Assistance provided but zero liability for claim outcomes.
  2. Vendor Liability: Final service quality responsibility rests with hotels/transport partners.

General Terms

  1. Jurisdiction: All disputes subject to courts in Bengaluru, India.
  2. E&OE (Errors & Omissions Excepted): We reserve right to correct pricing/terms.
  3. Proof Requirements: Medical/emergency claims require valid documentation.
  4. Non-Transferable: Bookings/vouchers strictly under original customer name.
  5. Voucher Expiry: Unused vouchers forfeited after 90 days.
  6. Bank Charges: 2.5% deduction on all refunds for payment processing.
  7. Itinerary Compliance: Strict adherence to scheduled timings; delays may forfeit services.

Critical Policies

  1. "Travel Secure Premium" (Trains): Replaces "Trip Guarantee"; follows Clause 10 cancellation rules.
  2. Force Majeure Clause: No compensation for disruptions beyond our control.
  3. Voucher Supremacy: Details in final vouchers constitute binding service terms.
  4. Deposit Forfeiture: 50% advance payment non-refundable under any cancellation.
  5. Refund Processing Time: All refunds (if approved) will be processed within 15-30 business days after documentation verification.
  6. Voucher Redemption Rules: Travel vouchers must be redeemed online via RoamMyWay portal only. Voucher value cannot be split across multiple bookings.
  7. Hotel Check-in/out Policy: Standard check-in: 2 PM | Check-out: 12 PM. Early check-in/late check-out subject to availability and extra charges.
  8. Flight Rebooking: Airline schedule changes may require rebooking; difference in fare to be paid by traveler. No refunds for voluntary flight changes within 72 hours of departure.
  9. Train "Travel Secure Premium": Guarantees alternate travel options if original train is unavailable. Cancellations under this plan follow Clause 10 refund rules.
  10. Child Policy: Children (3-11 years): 75% of adult price for hotels/activities. Flight/train charges as per operator rules.
  11. Private Transfer Rules: Waiting time beyond 60 mins at airport/station: ₹200/hour charge. Route deviations require prior approval + extra fees.
  12. Weather Contingencies: Mountain/beach activities may be canceled for safety; no cash refunds (voucher issued instead).
  13. Proof Requirements for Refunds: Medical emergencies: Hospital certificate + doctor’s note. Death cases: Death certificate + relationship proof.
  14. Promotional Vouchers: Limited to one voucher per booking. Cannot be combined with other offers.
  15. Data Privacy: Payment details are encrypted; we never store CVV/Card PINs. Contact details may be shared with vendors for service delivery.
  16. Intellectual Property: All itineraries/content are RoamMyWay copyrights. Unauthorized commercial use incurs ₹50,000 penalty.
  17. Governing Law: Indian Contract Act, 1872 governs these terms. Arbitration in Bengaluru (English language) before court proceedings.
  18. Termination Rights: RoamMyWay may cancel bookings if: a) Fraudulent information is provided b) Balance payment is delayed >72 hours c) Threats to staff/vendors occur
  19. Force Majeure Definition: Includes but not limited to: Natural disasters, War/terrorism, Government lockdowns, Airspace closures, Pandemic declarations by WHO
